1. Introduction:
- 1.1 This is a legal agreement between you, i.e., the person accessing, viewing, or using the web application available at iJaipuria, www.ijaipuria.com (the “Website”) (referred, in this document, to as “you”, “your” or “User” as the case may be) and Jaipuria Educational Services Private Limited, a company incorporated under the provisions of the Companies Act, 2013, and having its registered office at 1/3 (Block 1, Plot No 3) WHS Timber Market, Kriti Nagar, Near Mayapuri Chowk, New Delhi – 110015 (“iJaipuria” , “us”, “our”, or “we”, “Company”).
- 1.2iJaipuria is a platform that enables the dissemination of educational content to User through different media including but not limited to audio, visual, textual, or physical means, whether live or pre-recorded, specific details of which are more fully described in the sales brochures made available to you under the web page for each specific course on our Website (the “Services”). Services shall also include any incidental or ancillary Services provided by iJaipuria through the Website, or through any online or offline platform that may be opted by iJaipuria in its sole discretion for transmission of its Services in the future, including but not limited to mobile applications or electronic devices. These Services are provided to you subject to these Terms and may be utilized by you, solely for your own use, and not for the use or benefit of any third party.
- 1.3This document (the “Terms”) sets forth the legally binding terms and conditions for your use of the Website and any other platforms that may be made available to you in the future including, but not limited to, mobile applications and electronic devices (collectively referred to as the “Platform”) in connection with our Services. These Terms shall govern the use of this Website and our Services by all User, irrespective of whether such User is a subscriber of free or paid Services. Therefore, please read these Terms carefully before using this Website and availing of the Services offered by us.
- 1.4 These Terms shall apply to iJaipuria-hosted mobile apps, WhatsApp groups, Facebook groups, Instagram pages, Facebook pages, email/SMS/phone communications and other social media forums hosted by iJaipuria, which shall be deemed to be part of the Platform by reference. You acknowledge that certain parts of the Platform, as mentioned above, are provided by third-party service providers, and you agree to abide by their terms and conditions. iJaipuria shall not be responsible for any disruption of Services caused by such third-party service providers.
- 1.5Although you may bookmark a particular portion of the Platform and thereby bypass these Terms, your use of the Platform still binds you to these Terms. We may change these Terms from time to time without prior notice. You should review this page regularly. Your continued use of the Platform and Services after changes have been made will be taken to indicate that you have read and accepted those changes. You should not use the Platform or Services if you are not happy with any changes to these Terms.
- 1.6 iJaipuria makes no representations that the Platform operates (or is legally permitted to operate) in all geographic areas or that the Platform, or information, Services or products offered through the Platform are appropriate or available for use in other locations. Accessing the Platform from territories where the Platform, or any Content or functionality of the Platform or its portions thereof, is illegal is expressly prohibited. If you choose to access the Platform, you agree and acknowledge that you do so on your own initiative and at your own risk and that you are solely responsible for compliance with all applicable laws.
- 1.7 Please read these Terms carefully, and contact us if you have any questions, requests for information, or complaints. By clicking “I accept” (or for those who have not yet created an account, by using our Services), you agree to be bound by these Terms. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms.
2. Registration of User:
- 2.1 In order to participate in most Platform activities and to apply for a Services, you will need to register for a personal account (the “User Account”) by undergoing a two-step verification process to verify your login credentials such as your phone number, by way of a one-time password which will be sent to your phone number simultaneously and/or by providing an email address and a password that is unique.
- 2.2 Upon payment of the program fees, in part or whole, depending on the Services, iJaipuria shall deliver the terms of use of the program and grant you access to the program. The invoice may be provided to you along with the email confirmation or within two (2) months thereafter. This shall be a proof of delivery against the successful payment of fees
- 2.3 You agree that you will never divulge or share access to your User Account with any third party for any reason. You also agree that you will create, use and/or access only one User Account and that you will not use any User Account other than your own.
- 2.4 In setting up your User Account, you may be prompted or required to enter additional information, including but not limited to your name and email address. Additional information may be required to confirm your identity. You understand and agree that all information provided by you is accurate, current and complete and that you will maintain and update your information to keep it accurate, current and complete. You acknowledge that if any information you provide is untrue, inaccurate, not current, or incomplete, we reserve the right to terminate your use of the Platform and your enrolment into Services to the extent applicable.
- 2.5 In addition to the registration process, as part of your use of the Platform or participation in the Services, we may obtain certain information about you and your performance in the Services. Some of this information may be ‘Personally Identifiable Information.’ We may use, maintain, and store this information to provide certain services to you now and in the future, and may share such information with our educational partners or third parties in conjunction with such services or for the purpose of marketing.
- 2.6 By registering your User Account, you agree that:
- you are registered for the Services only once and will not set up multiple User Accounts; and
- you will abide by these Terms and any terms specific to the program.
- 2.7 Registration is a one-time process and if you have been previously registered, you shall login/sign into your account using the same credentials as provided by you during the registration process.
- 2.8 You represent and warrant that if you are an individual, you are of legal age to form a binding contract. If you are not of legal age, you may only access, use and register on this Website with the consent of and under the supervision of a parent or legal guardian. Please note that if a User is younger than the legal age to form a binding contract, we assume that the parent or guardian of such minor has read and understood these Terms and is supervising the minor’s usage of the Website and availing of Services. iJaipuria reserves the right to terminate your registration and subscription if it is brought to our notice that you do not satisfy the legal age requirement and your usage of our Website or availing of Services was not with the consent of a parent/guardian as stipulated herein.
- 2.9 You are solely responsible and liable for any activity that occurs on or through your account and you shall be responsible for maintaining the confidentiality of your password. You agree not to provide any other person with access to your account. You shall immediately notify us in writing of any unauthorized use of your account, or other account related security breach of which you are aware.
- 2.10 Additional requirements apply to students. As a student, in addition to the points above, you agree that you are registering with the intent to complete the assignments, if any, that are relevant and applicable to the Platform or Services into which you have enrolled.
3. Pricing and Payment:
- 3.1 You agree to pay all fees and applicable charges for Services you avail from us. All fees and applicable charges are payable in full and in advance and will be valid until the completion of the period of your selected Services or until cancelled or terminated in accordance with these Terms. We reserve the right to delete or suspend your access to Services for incomplete payment of fees and applicable charges.
- 3.2 We use third-party payment gateways or aggregators (the “Third Party Payment Service Providers” ) to collect fees and applicable charges. Such Third Party Payment Service Providers are independent service providers and not agents or employees of iJaipuria and are independent of and not connected to iJaipuria in any manner whatsoever. In the event that you are re-directed to any external website or application of such Third Party Payment Service Providers, we disclaim all liability regarding (a) the privacy of your information shared on such websites or applications; (b) security and protection measures for the information and data shared and technology employed on such websites or applications and (c) any and all interaction, correspondence, transactions that may occur between you and such Third Party Payment Service Providers. We strongly advise you to read and understand the terms and conditions and privacy policy and any other policies that may be applicable and available on their platform before using their services and sharing any information with them.
- 3.3 iJaipuria does not store any of your credit card information or such other information restricted by the Reserve Bank of India (RBI) for processing payment and has partnered with payment gateways for the payment towards the Services
The information that we receive from you as detailed in the paragraph above is hereinafter, collectively referred to as “Personal Information”.
4. Refund Policy:
- 4.1 You acknowledge that the Services you purchased are non-transferable and non-refundable. You acknowledge that we are under no obligation to refund any fees and applicable charges paid by you, in full or partially, under no circumstances, including for modifying and extending the duration of the Services, change in the commencement date of the Services, your failure to attend or participate in the Services, modification of the structure or Content of the Services.
- 4.2 If a refund is provided, you hereby agree and acknowledge that such amount to be refunded may either be paid in cash or credit (for purchase of any other Services of iJaipuria of equivalent value) at the sole discretion of iJaipuria.

5. Intellectual Property Rights:
- 5.1 “Content” means any and all information and data, which may include but not be limited to text, software, scripts, graphics, maps, photos, sounds, music, videos, logos, offers, advertisements, interactive features and other materials.
- 5.2 The Platform, programs and related Services are owned and operated by iJaipuria and its licensors. All Content or other material available on the Platform or through the programs, including but not limited to online/live lectures, speeches, video lessons, quizzes, presentation materials, homework assignments, programming assignments, programs, code, and other images, text, layouts, arrangements, displays, illustrations, documents, materials, audio and video clips, HTML and files (collectively “iJaipuria Content” ), are the property of iJaipuria and/or its affiliates or licensors, and are protected by copyright, patent and/or other proprietary intellectual property rights under Indian and foreign laws. All software used on the Platform is the property of iJaipuria and is protected by Indian and international copyright laws.
- 5.3 iJaipuria logos, trademarks and service marks that may appear on the Platform and in the Program (the “iJaipuria Marks” ) are the property of iJaipuria and are protected under Indian laws. All other trademarks, service marks and logos used on the Platform, online courses or programs, with or without attribution, are the trademarks, service marks or logos of their respective owners. In addition, elements of the Platform are protected by trade dress and other Indian and international intellectual property laws and may not be copied, reproduced, downloaded or distributed in any way in whole or in part without the express written consent of iJaipuria.
- 5.4 As a condition of accessing the Platform and/or using the programs, you agree not to (a) reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose any iJaipuria Content or any portion of it thereof, other than as expressly allowed under these Terms; and (b) use the iJaipuria Marks or the name, trademarks, service marks, or other materials of any educational partner in connection with, or to transmit, any unsolicited communications or emails or for any other unauthorized purpose.
- 5.5 Please verify all Content prior to use. In the event you come across any Content that is incorrect, infringing, offensive, indecent or objectionable, please notify us immediately at the address mentioned at the bottom of this page.
- 5.6 Please note that the Website may include Content, whether publicly posted or privately transmitted which is created and provided by other User or third parties. However, we cannot and do not guarantee the authenticity of any such Content. You acknowledge that all Content you access in connection with the Services is at your own risk and you will be solely responsible and liable for any damage or loss to you resulting from it.
6. User conduct and guidelines:
Users are expected to maintain a reasonable standard of decorum, decency and integrity while using the Website and Services. You acknowledge and agree:
- 6.1 to be respectful, professional, and inclusive in all your interactions and communications and usage of the Website and Services and any other platform on which iJaipuria may organize a group discussion;
- 6.2 to ensure that any communication made by you on this Website or on any present or future platform of iJaipuria in connection with our Services shall not be harmful, harassing, blasphemous, defamatory, pornographic, libelous, invasive of another’s privacy, hateful, disparaging, relating to or encouraging of money laundering or gambling, illegal, obscene, defamatory, injurious to third parties, racially or ethnically objectionable, politically, religiously, or sexually objectionable;
- 6.3 not to communicate or behave in a manner that is harmful to minors in any way;
- 6.4 not to reproduce or distribute, for commercial gain or otherwise, through any medium, any part of the Services offered to you unless with our express written consent;
- 6.5 not to tamper, alter or modify any part of the technology of the Website and Services over which you are given access;
- 6.6 not to make false or malicious statements against the Services offered by us;
- 6.7 not to use the Website or Services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into our Website or Services or any of our operating system;
- 6.8 not to engage in any form of antisocial, disrupting, or destructive acts, including flaming, spamming, flooding, trolling and phishing, as those terms are commonly understood and used on the internet;
- 6.9 not to use the Website or any Services in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other User;
- 6.10 not to release any software virus or use any computer code, file, or program that is designed to interrupt, destroy, or limit the functionality of any computer resource of iJaipuria;
- 6.11 not to carry out reverse engineering in respect of the hardware or software underlying the Website or Services or any part thereof;
- 6.12 to comply with any applicable law and regulation relating to downloading and or using the Content and or technology in connection with the Website or Services;
- 6.13 not to share any information pertaining to a third party to which the User does not have any right to share;
- 6.14 not to infringe any patent, trademark, copyright, or other proprietary rights of any third party;
- 6.15 not to deceive or mislead an addressee about the origin of such messages or communication that is grossly offensive or menacing in nature;
- 6.16 not to impersonate another person;
- 6.17 not to share any information that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity, or agency for financial gain or to cause any injury to any person; and
- 6.18 not to behave or communicate in a manner that threatens the unity, integrity, defence, security or sovereignty of India, its friendly relation with states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting to any other nation.
7. Personal information and data security:
- 7.1 Please refer to our ‘Privacy Policy’ available at www.ijaipuria.com to understand how we collect, use, share and protect your data and personal information.
8. Indemnity:
- 8.1 You agree to indemnify and hold iJaipuria and its educational partners harmless from any and all claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees and costs, relating to or arising out of (a) your use or attempted use of the Platforms or programs in violation of the Terms; (b) your violation of any law or rights of any third party; or (c) information or Content that you or others post or otherwise make available on the Platform or through any program, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
9. Limitation of liability:
- 9.1 Neither iJaipuria nor any of its educational partners, affiliates, employees, directors, officers, agents, vendors or suppliers shall be liable to you or any other person, whether in ‘Tort’, ‘Contract’, ‘Strict Liability’ or otherwise, for any indirect, special, incidental or consequential losses or damages of any nature arising out of or in connection with the use or inability to use this Platform or programs, including, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of search results, or computer / electronic device failure, virus or malfunction.
- 9.2 Nothing contained herein shall be deemed to exclude or limit your liability in respect of any indemnity given by you under these Terms.
- 9.3 Without prejudice to the foregoing, none of the directors, officers, employees, and agents of iJaipuria shall be personally liable for any action in connection with the Website or Services.
10. Third-Party Apps
- 10.1 Your use of the Website and Services may lead you to links to other websites or applications on the internet. When you access third-party websites, you do so at your own risk. These other websites are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or applications. The inclusion of any such link does not imply our endorsement of such websites or applications or association with its operators. You further acknowledge and agree that we shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or application.
11. Termination of Services / deletion of account:
- 11.1 You agree that iJaipuria, in its sole discretion, may deactivate your account or otherwise terminate your use of the Platform or enrolment to a program with or without reason, including, without limitation, if iJaipuria believes that you have (a) breached the Terms; (b) infringed the intellectual property rights of a third party; (c) posted, uploaded or transmitted unauthorized Content on the Platform; or (d) violated or acted inconsistently with the letter or spirit of these Terms or any other applicable code of conduct.
- 11.2 You agree that any deactivation or termination of your access to the Platform or Services may be affected without prior notice to you and that iJaipuria shall not be liable to you nor any third party for any termination of your account or enrolment into a program. You also acknowledge that iJaipuria may retain and store your information on iJaipuria’s systems notwithstanding any termination of your account or enrolment into the program.
12. Modification of Terms of use:
- 12.1 We reserve the right, at our sole discretion, to modify or replace any of the terms of these Terms, or change, suspend or discontinue any of our Services at any time with due notice to you via the Website or by email. We may also impose limits on certain features and restrict your access to certain parts of the Website without notice or liability. You acknowledge that it is your responsibility to check these Terms for updates periodically. Your continued use of the Website and Services following the posting of any changes to these Terms will be deemed to constitute an acceptance of those changes.
13. Applicable law and jurisdiction:
- 13.1 These Terms shall be governed by and construed in accordance with the laws of India. For the purposes of these Terms, you consent to the courts of New Delhi, India having exclusive jurisdiction over any and all disputes that arise out of, or in relation to or connected with these Terms.
- 13.2 Where a dispute arises, the parties involved shall make all reasonable efforts to resolve the dispute through good faith negotiations. If efforts to amicably resolve any dispute or claim between the parties are unsuccessful, then such dispute or claim arising out of or in connection with the Terms or any program-specific terms shared with you, including any question regarding its existence, validity or termination, shall be referred to arbitration under the Arbitration and Conciliation Act, 1956, before a sole arbitrator to be appointed by iJaipuria. The proceedings shall be conducted in English and the seat for arbitration shall be New Delhi, India.
14. Miscellaneous:
- 14.1 These Terms contain the entire agreement between you and iJaipuria with respect to the subject matter hereof, and neither one of us shall have any obligation, express or implied by law, except as set forth herein.
- 14.2 Any failure to enforce any provision of these Terms shall not constitute a waiver thereof or any other provisions.
- 14.3 In the event any provision contained herein is held to be invalid by a court of competent jurisdiction then the remaining portions of these Terms shall remain in full force and effect.
- 14.4 These Terms may be modified or amended, and any obligation waived at the sole discretion of iJaipuria.
- 14.5 Unless otherwise specified in these Terms, all notices under these Terms shall be in writing and will be deemed to have been duly given when received, personally delivered, or sent by certified or registered mail, return receipt requested; when receipt is electronically confirmed, if transmitted by e-mail; or the day after it is sent, if sent for next day delivery by recognized overnight delivery service.
- 14.6 In the event that you feel that your concern has not been resolved to your satisfaction, you may contact our grievance officer, who shall endeavour to redress the concern within 30 working days from the date of escalation. You are advised to escalate to the grievance officer only when you have already raised your complaint which has not been resolved to their satisfaction, or their concern has not been resolved within 30 working days from the date of ticket generation.
- 14.7 In compliance with the Information Technology Act, 2000 and rules made thereunder and also in compliance with the Consumer Protection (E-Commerce) Rules, 2020 the name and contact details of the ‘Grievance Officer’ are herein as under:
